Acceptable Use Policy

1. Overview

This Acceptable Use Policy ("AUP") governs your use of BeforeMerge ("Service"), operated by Chykalophia LLC. This AUP is incorporated by reference into our Terms of Service. By using the Service, you agree to comply with this AUP.

This policy is designed to protect the integrity of our platform, the experience of our users, and the security of data entrusted to us. We expect all users to use the Service responsibly and in good faith.

2. Prohibited Activities

You may not use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon or violate the intellectual property rights, privacy rights, or other rights of any third party
  • Transmit any malware, viruses, worms, or other malicious code
  • Engage in any activity that disrupts, degrades, or interferes with the Service or its infrastructure
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Harass, threaten, or intimidate other users of the Service
  • Send unsolicited communications, spam, or bulk messages through or using the Service
  • Use the Service to process or store sensitive personal data (e.g., health records, financial account numbers, government identification numbers) unless explicitly supported
  • Attempt to access areas of the Service, servers, or systems that you are not authorized to access

3. Scraping and Data Collection

You may not:

  • Use automated tools, bots, scrapers, or crawlers to extract data from the Service, including code review rules, knowledge base content, user data, or platform metadata
  • Systematically download or collect content from the Service for the purpose of building datasets, training machine learning models, or populating competing products
  • Use data mining, robots, screen scraping, or similar data gathering techniques on any part of the Service
  • Mirror or frame any part of the Service on another website or application without our prior written consent

Authorized API access is not considered scraping, provided it is within the rate limits and usage terms described in our Terms of Service and API documentation.

4. API Abuse

If you access the Service through our API, you must not:

  • Exceed published rate limits or make requests at a frequency that degrades the Service for other users
  • Use the API in a manner inconsistent with its documented purpose
  • Share, publish, or distribute your API keys or authentication tokens
  • Attempt to circumvent any rate limiting, authentication, or access controls
  • Use the API to build an automated pipeline that replicates the Service's core functionality for redistribution
  • Make API calls from automated systems without implementing proper error handling and exponential backoff

5. Competitive Restrictions

You may not use the Service to:

  • Build, enhance, or market a product or service that directly competes with BeforeMerge
  • Reverse engineer, decompile, or deconstruct any proprietary algorithms, processes, or methodologies used by the Service
  • Systematically extract code review rules, AI-generated insights, or knowledge base structures for use in a competing product
  • Benchmark the Service against competing products for the purpose of publishing comparative analysis without our prior written consent

These restrictions do not apply to BeforeMerge's open-source components released under the MIT license at github.com/BeforeMerge/beforemerge-skills, which may be used in accordance with their license terms.

6. Content Restrictions

You may not upload, submit, or transmit through the Service any content that:

  • Is unlawful, defamatory, obscene, abusive, or otherwise objectionable
  • Contains or promotes violence, discrimination, or hatred against individuals or groups
  • Infringes on any third party's intellectual property, trade secrets, or proprietary rights
  • Contains sensitive personal data of others without their consent
  • Is designed to exploit or harm minors in any way

7. Security

You may not:

  • Probe, scan, or test the vulnerability of the Service or any related system or network without authorization
  • Breach or circumvent any security or authentication measures
  • Access data not intended for you, or log into a server or account that you are not authorized to access
  • Attempt to interfere with the Service's operation, including denial-of-service attacks, flooding, or deliberate overloading
  • Forge any TCP/IP packet header or any part of the header information in any email or posting

If you discover a security vulnerability, we encourage responsible disclosure. Please report it to hello@beforemerge.dev rather than exploiting it.

8. Enforcement

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this AUP. Actions may include:

  • Issuing a warning to the violating user
  • Temporarily suspending access to the Service
  • Permanently terminating the user's account
  • Removing or disabling access to violating content
  • Reporting the activity to law enforcement authorities
  • Pursuing legal remedies, including injunctive relief and damages

We will make reasonable efforts to notify users before taking enforcement action, except in cases where immediate action is necessary to protect the Service, its users, or third parties.

9. Reporting Violations

If you believe a user is violating this Acceptable Use Policy, please report it to us at hello@beforemerge.dev. Please include as much detail as possible, including:

  • A description of the violation
  • The identity of the violating user (if known)
  • Any supporting evidence or screenshots
  • The date and time of the violation

We take all reports seriously and will investigate promptly. We may not be able to share the details of our investigation or any actions taken due to privacy considerations.
